Terms of Service

By installing or using Agmente (the "App") from HalliHarp LLC ("we"), you agree to these Terms. If you disagree, do not use the App.
1. Description of service
Agmente is an iOS client for connecting to ACP-compatible AI agent servers. The App:
- Connects to WebSocket servers you configure
- Sends your messages to those servers
- Displays responses from those servers
- Stores configuration data locally on your device
The App does not provide AI services itself—you must supply an agent server.
2. User responsibilities
2.1 Agent servers
You are responsible for providing, securing, and paying for your agent servers and ensuring they comply with applicable laws.
2.2 Content
You are responsible for all content you send and for complying with the terms of your AI providers. Do not use the App for illegal, harmful, or abusive purposes.
2.3 Security
Keep authentication tokens and device access secure. Do not share credentials with unauthorized parties.
3. Acceptable use
You agree not to:
- Violate laws or regulations
- Infringe intellectual property rights
- Transmit malware or interfere with systems
- Harass, abuse, or impersonate others
- Generate illegal, harmful, or offensive content
- Circumvent security measures
4. Intellectual property
The App and documentation are protected by law; we retain all rights not expressly granted.
Open source components
Open source dependencies are governed by their own licenses.
Your content
You retain ownership of your content. We do not receive or store it.
5. Third-party services
AI agent providers
The App connects to third-party AI services you choose. Their terms apply (for example, Google Gemini, Anthropic Claude). We are not responsible for their availability or data practices.
Cloudflare
If you use Cloudflare services, you must comply with Cloudflare's Terms of Service.
6. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind. We do not warrant that the App will meet requirements, be uninterrupted, or that results will be accurate.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, data, use, or goodwill; damages from third-party AI services; or more than the amount you paid for the App (currently $0).
8. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the App, violations of these Terms, third-party rights, or content you transmit.
9. Changes to Terms
We may modify these Terms. Updates will appear on the website with a new date; continued use constitutes acceptance.
10. Termination
You may stop using the App by uninstalling it. We may suspend or terminate access if you violate these Terms.
11. Governing law
These Terms are governed by the laws of your jurisdiction, without regard to conflict-of-law principles.
12. Dispute resolution
Disputes will be resolved by good-faith negotiation for 30 days, followed by binding arbitration if unresolved. Class actions and class arbitrations are waived.
13. Severability
If any provision is unenforceable, the remaining provisions stay in effect.
14. Entire agreement
These Terms and the Privacy Policy are the complete agreement regarding the App.

App Store terms
Use of the App is also subject to the Apple Media Services Terms and Conditions.
License
The App is licensed (not sold) to you by HalliHarp LLC, not Apple.
Maintenance and support
We provide maintenance and support. Apple has no obligation to do so.
Warranty
We are responsible for any product warranties, to the extent required by law.
Product claims
We, not Apple, address claims relating to the App or your use of it.
Third-party intellectual property claims

Legal compliance
You confirm you are not located in a country subject to U.S. embargo and are not on a U.S. prohibited or restricted parties list.
Third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
